It goes without doubt that Frontex has to respect fundamental human rights principles, both
regarding the control of the European external borders and concerning the expulsion of displaced people. In the past, however, reports have also suggested that Frontex may have been involved in acts of violence and human rights violations.
In the revision period of the Frontex mandate, it is of utmost importance to open up a debate on the obligation of Frontex to guarantee, protect and promote fundamental rights on its missions. This involves the establishment of clear-cut responsibilities for Frontex, the EU Member States and third countries involved in the coordination of the missions concerned.
Will the entry into force of the Lisbon Treaty and the adoption of the Stockholm Programme by the European Council of 10-11 December 2009, which requires “a clarification and enhancement of the role of Frontex regarding the management of the external borders of the European Union”, have any impact on the Agency’s mission?
Should the new mandate include an efficient and independent evaluation as well as a monitoring mechanism to guarantee, protect and promote fundamental rights in future missions? What will be the role of the European Parliament and how can civil society be involved?
